The Magee 1866 website is provided solely for your personal use.

Magee 1866 only offers products for sale that are in stock and available for dispatch from its warehouse. Although much effort has gone into producing high quality images of our product selection, we cannot guarantee that your monitor will correctly replicate the colours.

Magee 1866 reserves the right to modify these Terms of Conditions from time to time.

2. TERMS OF SALE

2.1. By placing an order you are offering to purchase a product on and subject to the following terms and conditions. All orders are subject to availability and confirmation of the order price.

2.2. Dispatch times may vary according to availability and any guarantees or representations made as to delivery times are subject to any delays resulting from postal delays or force majeure for which we will not be responsible.

2.3. In order to contract with Magee 1866 you must be over 18 years of age and possess a valid credit or debit card issued by a bank acceptable to us. Magee 1866 retains the right to refuse any request made by you. If your order is accepted we will inform you by email. When placing an order you undertake that all details you provide to us are true and accurate, that you are an authorised user of the credit or debit card used to place your order and that there are sufficient funds to cover the cost of the goods. All prices advertised are subject to such changes.

3. OUR CONTRACT

3.1. When you place an order, you will receive an acknowledgement e-mail confirming receipt of your order. This email will only be an acknowledgement and will not constitute acceptance of your order. A contract between us for the purchase of the goods will not be formed until your payment has been approved by us and we have debited your credit or debit card.

4. PRICING AND AVAILABILITY

4.1. Whilst we try and ensure that all details, descriptions and prices which appear on this Website are accurate, errors may occur. If we discover an error in the price of any goods which you have ordered we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund.

4.2. The Service may contain typographical errors or other errors or inaccuracies and may not be complete or current. We therefore reserve the right to correct any errors, inaccuracies or omissions and to change or update information at any time without prior notice. We reserve the right to refuse to fill any orders that you may place based on information on the Service that may contain errors or inaccuracies, including, without limitation, errors, inaccuracies or out-of-date information regarding pricing, shipping, payment terms, or return policies.

5. PAYMENT

5.1. Upon receiving your order we carry out a standard pre-authorisation check on your payment card to ensure there are sufficient funds to fulfil the transaction. Goods will not be dispatched until this pre-authorisation check has been completed. Your card will be debited once the order has been accepted.

6. DISCOUNT CODES

6.1. Promotional discount codes - We may from time to time offer promotional discount codes which may apply in respect of any, or certain specified, purchases made though this Website. The conditions of use relating to any discount code will be specified at the time of issue.

7. INTELLECTUAL PROPERTY

7.1. Your use of the Magee1866.com site and its contents grants no rights to you in relation to any copyright, designs, trademarks and any other intellectual property and material rights relating to the Content (as described in the Content section below), including Magee 1866 Software and all HTML and other code contained in this Site. All such Content, including third party trademarks, designs and related intellectual property rights mentioned or displayed on this Site are protected by national intellectual property and other laws and international treaty provisions. You are permitted to use the Content only as expressly authorised by Magee 1866 and/or its third party licensors. Any reproduction or redistribution of the above listed Content is prohibited and may result in civil and criminal penalties.

9. PUBLIC FORUMS AND USER SUBMISSIONS

Magee 1866 is not responsible for any material submitted to the public areas by you (which include bulletin boards, hosted pages, chat rooms, blogs, or any other public area found on the website. Any material (whether submitted by you or any other user) is not endorsed, reviewed or approved by Magee 1866. Magee 1866 reserves the right to remove any material submitted or posted by you in the public areas, without notice to you, if it becomes aware and determines, in its sole and absolute discretion that you are or there is the likelihood that you may, including but not limited to -

10. SPECIFIC USE

10.1. You further agree not to use the website to send or post any message or material that is unlawful, harassing, defamatory, abusive, indecent, threatening, harmful, vulgar, obscene, sexually orientated, racially offensive, profane, pornographic or violates any applicable law and you hereby indemnify the Website Owner against any loss, liability, damage or expense of whatever nature which the Website Owner or any third party may suffer which is caused by or attributable to, whether directly or indirectly, your use of the website to send or post any such message or material.

11. REGISTRATION

11.1. By subscribing to our database, you agree that your details including your email address will be used to keep you informed about Magee 1866 news, promotions and products . The personal information you give us is kept secure and processed fairly and lawfully. We will not share your information with third parties for marketing purposes.

12. HOW TO PLACE AN ORDER

12.1. In order to make purchases through the Site, you will need to create an online account the first time you use the Magee 1866 Online Shop and you will be requested to provide information about yourself as indicated so that we may process your Order. You represent and warrant that the information provided by you is both valid and correct.

12.2. Once you have chosen a product, click on the image to access the product page where information on sizing, colour options and availability will be provided. All the prices are in Euro, with the option to see the price in Sterling or Dollars on that day’s current exchange rate. The prices will include VAT, but will not include delivery rates, as they vary from country to country. The cost of delivery will be clearly indicated further on in your order process.

12.3. If you are happy with your choice, click on the "Add to Basket" button.

12.4. You can monitor the products you have chosen by clicking on the "Shopping Basket" button at any time. You can also remove an item by clicking on the "Remove" button next to the chosen product.

12.5. When you are ready, proceed to "Checkout" and follow instructions. Please ensure that you provide information as requested.

12.6. Once you have confirmed your order, we will issue you with a Magee 1866 Order reference number, which will appear in your order confirmation email. Please ensure that you save this number for reference.

12.7. Once you have made your choice and your order has been placed, you will be required to enter your payment details. When you have completed this process, please click on the "Make Payment" button.

12.8. Your order will be acknowledged by an Order Confirmation message which allows you to make a final review of your order, including your payment reference giving details as registered by our system. This message is NOT an acceptance of your order.

12.9. Magee 1866 will also send you an Order Confirmation email containing information as set out above and a second email informing you when your order is dispatched.

12.10. We reserve the right not to accept your order. Such non-acceptance may result, for example, from the fact that a product ordered is out of stock or that we are unable to obtain authorisation for your payment.

12.11. Furthermore, we retain the express right not to process a transaction at any time at our sole discretion. In this event, we will not be liable to you or any third party by reason of our withdrawing any merchandise from Magee 1866’s Online Shop, whether or not such products have been sold.

13. PAYMENT SAFETY AND SECURITY

We accept major payment cards, namely American Express, MasterCard and Visa . Payment will be debited and cleared from your account upon receipt of your order by Magee 1866. You confirm that the credit/debit card that is being used is yours. All credit/debit card holders are subject to validation checks and authorisation by the card issuer.
If the issuer of your payment card refuses to authorise payment to Magee 1866, we will not be able to process your order and a message will appear informing you that the transaction cannot be processed.

14. Magee 1866, together with its partners, takes all reasonable care to make its Online Shop as secure as they can. All payment card transactions on this site are processed using a secure online payment gateway provided by our partner Skrill/Moneybookers, that encrypts your card details in a secure host environment. We do not hold your payment card details on the Magee 1866 server.

15. Although we will employ all reasonable care to ensure that details of your order and payment are held secure, we cannot be held liable for any loss you may suffer if a third party procures unauthorised access to any data you provide when accessing or ordering from the Magee 1866 Online Shop.

16. RETURNS AND EXCHANGE POLICY

We are happy to accept items returned to us within 28-days of purchase. We will refund your credit or debit card once the items are received and processed.

Items returned to us after the 28-day grace period will not be eligible for an exchange/credit. Any returns received outside this time frame may be considered at the discretion of Magee 1866, and may only be refunded as a credit against a future purchase.

Please understand that items must be returned to us in the same condition as they were shipped. They must be in an unused and perfectly saleable condition.

Magee 1866 reserves the right to refuse a return if it’s determined that an item has been worn and then returned for any reason other than being 'faulty'.

Payment for returns is the Customer's responsibility.

Please note that there are no returns on altered garments.

17. IN STORE LOYALTY CARD PROGRAM

The Loyalty program is for in store purchases only from Magee of Donegal and South Anne Street Dublin. Loyalty card is not transferable and must only be presented by the cardholder. It has no cash, debit, credit, charge card or cheque value. It may not be exchanged for cash or gift cards. We will not be held responsible for lost, stolen or damaged cards. Loyalty benefits are not available during sale periods. Magee 1866 reserve the right to amend the terms and conditions at any time or to terminate the use of the Loyalty Card at any time for any reason without prior notice to you. The loyalty card remains the property of Magee 1866. We hope you enjoy shopping with us.

18. INTERNATIONAL SHIPPING

PLEASE NOTE: Certain countries may charge additional customs fees. Magee1866.com cannot reimburse you for any additional fees incurred.
